These terms and conditions ("Agreement") sets forth the general terms and conditions of your use of the genderrevealideas.com.au website ("Website" or "Service") and any of its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", you or "your") and Gender Reveal Ideas ("Gender Reveal Ideas", "we", "us" or "our"). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. These terms of conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you do not agree with the terms of this Agreement, you not allowed to access and use the Website and Services. You acknowledge that this Agreement is a contract between you and Gender Reveal Ideas, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services. 

Terms 

By accessing, purchasing, and using the Website and Services, you accept that Gender Reveal Ideas is only a online store and that you have read the product descriptions on the website.

Our products are designed for safe, commercial use. However, Gender Reveal Ideas assumes no responsibility for any property damage, physical harm, or any incidents arising from fire, allergic reactions, or ingestion of our products. The user is 100% liable for any such occurrences. 

Billing and payments 

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Scans for malware are performed on a regular basis for additional security and protection. If, in our judgment, your purchase constitutes a medium or high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. 

Accuracy of information 

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. Occasionally, information on the Website may contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers. We reserve the right to modify, amend and correct any inaccuracies, errors or omissions, and to change or update information or cancel orders if any information on the Website or Services is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information on the Website including, without limitation, pricing information, except as required by law.

We reserve the right to terminate your use of the Website and Services for violating any of the prohibited uses. 

Intellectual property rights

This Agreement does not transfer to you any intellectual property owned by Gender Reveal Ideas or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Gender Reveal Ideas. All trademarks, service marks, graphics and logos used in connection with the Website and Services, are trademarks or registered trademarks of Gender Reveal Ideas or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Website and Services may be the trademarks of other third parties. Your use of the Website and Services grants you no right or license to reproduce or otherwise use any of Gender Reveal Ideas or third party trademarks. 

Limitation of liability 

To the fullest extent permitted by applicable law, in no event will Gender Reveal Ideas, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification 

You agree to indemnify and hold Gender Reveal Ideas and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any wilful misconduct on your part. 

Changes and amendments 

We reserve the right to modify this Agreement or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes. 

Note that our warranty does not cover damages caused by external factors such as mishandling during shipping, rough handling, or any other issues related to packaging upon arrival. We recommend inspecting the package upon receipt and reporting any visible damage to the shipping carrier.

For any manufacturing defects or faults unrelated to packaging, we stand by the quality of our Gender Reveal Golf Balls. If you encounter any issues with the product itself, please contact our customer service team within 30 days from the date of purchase.

Any modifications, changes, disassembly or use of third-party products paired with any of our products will fail to come under the ACCC return policy and you will be liable for any damages caused.  

We will always do our best to ensure all products purchased from our website meet expectations and are as described. In the event a product is returned for a refund for any other reason unrelated to warranty, you accept that you will be responsible for shipping costs if applicable. 

All refund, store credit, return or exchange claims will be assessed and a decision will be finalised by Gender Reveal Ideas. We do not accept change of mind refund requests, and furthermore reserve the right to refuse or grant a refund/store credit/exchange if you do not comply with the terms outlined within our policies. 

Acceptance of these terms 

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorised to access or use the Website and Services.
